Georgia says armed raid was in "enemy's" interests

TBILISI (Reuters) - Georgian officials said on Thursday gunmen who took hostages on its territory were Russian nationals and suggested they acted in the interests of the "enemy", while stopping short of blaming Moscow for the raid.

Georgian forces shot dead 11 gunmen and three of its soldiers were killed in an operation on August 29 to free hostages near the frontier with Russia's Dagestan region.

"We understand quite well in whose interests it was, it can only be in the interests of our enemy," President Mikheil Saakashvili was shown on Georgian television as telling residents of Lapankuri village, from where people were taken hostage.

Russian security officials denied there had been any illegal border crossings in the area.

Pro-Western Saakashvili, in power since 2004, is facing growing competition from a newly-created opposition group ahead of parliamentary elections in October.

Georgia fought a brief war with Russia in August 2008 after which Moscow recognized Georgian regions Abkhazia and South Ossetia as independent countries and increased its military presence in the regions.

Visiting Lapankuri, Saakashvili said "the enemy" was testing the combat-readiness of the Georgian army and assured Georgians they were well protected.

Parts of Georgia's porous border with Russia lie in remote areas of the Caucasus mountains and there have been reports in the past of fighters from Russia's turbulent North Caucasus infiltrating Georgian territory.

During its second war with Chechnya, launched in 1999, Moscow said Georgia's Pankisi Gorge on the border with Chechnya was being used as a shelter for militants. Georgia says there are no longer any militants from Russia there.

Georgia's Deputy Defence Minister Nodar Kharshiladze said the Lapankuri gunmen were Russian nationals from North Caucasus.

"As a result of the operation we have identified those combatants were Russian citizens," he told reporters in Tbilisi.

"Their origin is Northern Caucasus," he added.

"We hope that after apprehensions of some terrorists alive we will have more information. Investigation will be continued in this direction."

Math ability requires crosstalk in the brain

ScienceDaily (Aug. 29, 2012) ? A new study by researchers at UT Dallas' Center for Vital Longevity, Duke University, and the University of Michigan has found that the strength of communication between the left and right hemispheres of the brain predicts performance on basic arithmetic problems. The findings shed light on the neural basis of human math abilities and suggest a possible route to aiding those who suffer from dyscalculia-- an inability to understand and manipulate numbers.

It has been known for some time that the parietal cortex, the top/middle region of the brain, plays a central role in so-called numerical cognition--our ability to process numerical information. Previous brain imaging studies have shown that the right parietal region is primarily involved in basic quantity processing (like gauging relative amounts of fruit in baskets), while the left parietal region is involved in more precise numerical operations like addition and subtraction. What has not been known is whether the two hemispheres can work together to improve math performance. The new study demonstrates that they can. The findings were recently published online in Cerebral Cortex.

In the study, conducted in Dallas and led by Dr. Joonkoo Park, now a postdoctoral fellow at Duke University, researchers used functional magnetic resonance imaging, or fMRI, to measure the brain activity of 27 healthy young adults while they performed simple numerical and arithmetic tasks. In one task, participants were asked to judge whether two groups of shapes contained the same or different numbers of items. In two other tasks, participants were asked to solve simple addition and subtraction problems.

Consistent with previous studies, the researchers found that the basic number-matching task activated the right parietal cortex, while the addition and subtraction tasks produced additional activity in the left parietal cortex. But they also found something new: During the arithmetic tasks, communication between the left and right hemispheres increased significantly compared with the number-matching task. Moreover, people who exhibited the strongest connection between hemispheres were the fastest at solving the subtraction problems.

"Our results suggest that subtraction performance is optimal when there is high coherence in the neural activity in these two brain regions. Two brain areas working together rather than either region alone appears to be key" said co-author Dr. Denise C. Park, co-director of the UT Dallas Center for Vital Longevity and Distinguished University Chair in the School of Behavioral and Brain Sciences. Park (no relation to the lead author) helped direct the study along with Dr. Thad Polk, professor of psychology at the University of Michigan.

Lead author Dr. Joonkoo Park points out that the findings suggest that disrupted or inefficient neural communication between the hemispheres may contribute to the impaired math abilities seen in dyscalculia, the numerical equivalent of dyslexia. "If such a causal link exists," he said, "one very interesting avenue of research would be to develop training tasks to enhance parietal connectivity and to test whether they improve numerical competence."

Such a training program might help develop math ability in children and could also help older adults whose arithmetic skills begin to falter as a normal part of age-related cognitive decline.

This research was supported by a grant to Dr. Denise C. Park from the National Institute on Aging.

Isaac moves north after drenching U.S. Gulf, New Orleans

NEW ORLEANS (Reuters) - Tropical storm Isaac is expected to weaken further as it heads north on Thursday, after causing significant damage to the U.S. Gulf Coast but nothing on the scale of Hurricane Katrina, which devastated New Orleans in 2005.

The former Category One hurricane was likely to become a tropical depression on Thursday, and could still bring heavy rain and floods as it moved across the center of the country over the next few days, the National Hurricane Center said.

As Isaac ebbs, probes should show an elaborate flood containment plan developed for low-lying New Orleans survived its first major test, seven years to the day after Katrina laid waste to the city and killed more than 1,800 people.

And as the focus shifts from the coast, many further north will hope that Isaac brings rain desperately needed to ease a drought in the center of the United States, where summer crops have been ravaged and many rivers and dams are critically low.

The mayor of New Orleans, Mitch Landrieu, said the $14.5 billion system built for New Orleans by the Army Corps of Engineers - an array of walls, floodgates, levees and pumps - had performed "exactly as it should".

More than 730,000 residents of Louisiana and Mississippi were still without power.

Isaac never came close to the power of Katrina, which was a Category 3 hurricane on the five-step Saffir-Simpson scale when it smashed into New Orleans on August 29, 2005 - a day that still reverberates in the nation's psyche.

And early indications are that property damage from Isaac will not make the top-10 list of worst U.S. hurricanes by inflation-adjusted losses.

But the storm still produced major headaches, especially the seemingly endless rain that caught many long-time residents by surprise, trapped some on rooftops, and caused significant flooding in low-lying coastal areas.

SLOW MOVING

Isaac's advance slowed to a crawl after it first grazed the southeast Louisiana coast on Tuesday. That slowdown allowed it to pick up strength and dump rain for many more hours than expected. Flooding and storm surges forced thousands from their homes in areas not far from New Orleans.

"There is no such thing as 'just' a tropical storm," Craig Fugate, director of the Federal Emergency Management Agency, said after Isaac was downgraded on Wednesday.

U.S. President Barack Obama, declared the impact on Louisiana and Mississippi major disasters and ordered federal aid to supplement state and local recovery efforts.

It estimated total rainfall from Isaac of 7 to 14 inches, enough for widespread lowland flooding. Isolated maximum amounts over much of Louisiana and parts of Mississippi, Alabama and even Arkansas were expected to be as much as 25 inches.

Storm surges at high tide were also as high as 12 feet on the coast of Mississippi and southeastern Louisiana. Thousands were evacuated from St. John the Baptist Parish, north of New Orleans, after surges in Lake Pontchartrain and Lake Maurepas.

Tropical storm strength winds were blowing off the coasts of both states, though seas have been dropping over the past 24 hours as Isaac weakens, the NHC said early on Thursday. Tornadoes remained a risk, it said.

There was a heavy security presence in New Orleans to prevent any repeat of the days-long crime wave and general chaos that followed Katrina.

Police and National Guard units, many armed with assault rifles, patrolled dark and nearly deserted streets in downtown New Orleans, usually a hotbed of tourism.

The city was still being lashed by rain and high winds on Wednesday night and about 60 percent of all homes and businesses were without power.

GHOST TOWN

"It's a ghost town," said Sgt. Joseph Jennings, a member of the Louisiana Army National Guard patrolling the streets in an armored humvee.

"Everybody saw the widespread looting during Katrina and nobody wants that to happen again."

The darkness of the Lower Ninth Ward was eerily reminiscent of Katrina, when a nearby levee failed and the largely poor and black neighborhood was inundated by deadly floodwaters.

In the nearby Seventh Ward, one of the city's poorest and most crime-ridden areas, residents could be seen in shadows on porches, standing outside their darkened homes.

Earlier, along the shores of Lake Pontchartrain, Donalyn Lott watched a pumping station sucking water out of an overflowing drainage canal and into the lake.

"We're holding up pretty good ... no flooding," Lott said.

About 3,000 residents were forced from their homes in St. John the Baptist Parish, upriver from New Orleans, by flooding caused by storm surges.

Evacuations were also needed in Plaquemines Parish, a major shrimping area southeast of New Orleans that bore the brunt of the northward-moving storm.

Dozens were plucked from the roofs of their houses by local boatmen after earlier deciding they could ride out what compared with Katrina seemed like a small storm.

"This storm has delivered more of a punch than people thought," said Plaquemines Parish President Billy Nungesser.

More than 730,000 Louisiana and Mississippi customers of Entergy Corp and other local utilities were without power as of late Wednesday.

City officials also said Louis Armstrong New Orleans International Airport, which closed late on Monday, would remain shut on Thursday as the lines that supply it with power were knocked out by the storm.

Benchmark crude oil prices slipped on Wednesday on expectations that damage to oil facilities, offshore and along the coast, would be limited. Major oil companies including Royal Dutch Shell and Exxon Mobil Corp, began making plans to assess or restart operations.

Police look for motives in killing outside Empire State Building

NEW YORK, N.Y. - A gunman who killed a former co-worker in cold blood in the shadow of the Empire State Building and then was shot dead by police after he turned his gun on them spent long hours in the quiet of Central Park, photographing hawks and marveling over nature's beauty.

His victim was a gregarious salesman, beloved by his nieces and nephews as the fun uncle who could talk with equal expertise about the New York Jets and the women's fashion accessories he sold.

Investigators on Saturday were trying to piece together what caused Jeffrey Johnson, a T-shirt designer, to ambush Steve Ercolino, an apparel company vice-president, a day earlier outside the Manhattan offices of the company where they once were colleagues.

Police said Johnson hid behind a car and then killed Ercolino with five gunshots as he arrived for work. Johnson then was shot by two police officers who confronted him on a busy sidewalk.

Security camera footage showed the officers had only an instant to react when Johnson suddenly turned as they approached and pointed his gun at them, his arm cocked as if to fire.

Their encounter was over in eight seconds. The officers, who had been standing nearly close enough to shake hands with Johnson and had no opportunity to take cover, fired almost immediately.

Nine bystanders were wounded in the 16-shot volley, likely by stray or ricocheting police bullets. None of their injuries was life-threatening, police said.

Police investigating Johnson's killing of Ercolino were eyeing bad blood between them from when they worked together at Hazan Import, a garment district business where Ercolino was a vice-president of sales.

Johnson and Ercolino had traded harassment accusations when they worked together, police said, and when Johnson was laid off from the company a year ago he blamed Ercolino, saying he hadn't aggressively marketed his new T-shirt line.

After Johnson's layoff, neighbours said, he continued to leave his apartment every day in a suit.

Internet records listed Johnson as the administrator of the website for a business called St. Jolly's Art, which sold iron-on graphic art for T-shirts. Art for sale on the site included stylized drawings of fighter planes and muscle cars and whimsical "seafaring vignettes" featuring pirate maidens and tall ships.

Johnson also was part of a community of bird watchers and photographers who document hawks and other wildlife living in Central Park, a few blocks from his home.

In one email to another bird watcher who works at The Associated Press, Johnson wrote tenderly about spending a winter night watching ducks in the park.

"Near midnight by the Harlem Meer I watched a little 'flotilla' of Mallards swimming and softly honking ... fifteen degree temp and they were carrying on unfazed. Just remarkable," he wrote.

His photographs of Central Park's hawk population appeared regularly on blogs tracking the birds.

A neighbour who often saw Johnson, 58, said he was always alone.

"I always felt bad," said Gisela Casella, who lived a few floors above Johnson in a modest apartment building on the Upper East Side. "I said, 'Doesn't he have a girlfriend?' I never saw him with anybody."

Ercolino, 41, was described by his relatives as the opposite of a quiet loner.

His eldest brother, Paul Ercolino, said he was a gregarious salesman who often travelled, had a loving girlfriend and was the life of any family gathering.

"He was in the prime of his life," he said. "He would do anything for anybody at any time. ... He was so wonderful with my children. At Christmastime, he was the one who always had the best presents for the kids."

Paul Ercolino said his brother, known to nieces and nephews as Uncle Ducky because of his nearly blond hair, had followed his father into the garment industry after growing up in Nanuet, just north of New York City, then later worked in women's handbags and accessories. He said his brother had never mentioned to the family that he had any problems with a co-worker.

Hazan Import Corp. executives didn't return phone calls seeking comment Friday.

Johnson, after waiting for Steve Ercolino to come to work, walked up to him, pulled out a .45-calibre pistol and fired at his head, police Commissioner Ray Kelly said. After Ercolino fell to the ground, Johnson stood over him and shot four more times, a witness told investigators.

"Jeffrey just came from behind two cars, pulled out his gun, put it up to Steve's head and shot him," said Carol Timan, whose daughter, Irene Timan, was walking to Hazan Imports at the time with Ercolino.

In security camera footage released by the police, Johnson can be seen walking calmly down the sidewalk after the shooting, distancing himself slightly from the other pedestrians, who appear to have no awareness that anything is wrong.

But when two police officers approach in a hurry, Johnson turns and pulls a handgun from a bag. Then, the scene explodes into action. People seated on a bench behind the gunman and pedestrians standing close to the two officers run for their lives.

Only a young child seems not to react, strolling out of view of the camera as adults all around leap away in terror.

Startled New Yorkers later looked up from their morning routines in the crowded business district to see people sprawled in the streets bleeding and a tarp covering a body in front of the tourist landmark.

"I was on the bus, and people were yelling 'Get down! Get down!" accountant Marc Engel said. "I was thinking, 'You people are crazy. No one is shooting in the middle of midtown Manhattan at 9 o'clock in the morning.'"

It was over in seconds, he said ? "a lot of pop, pop, pop, pop, one shot after the other."

Afterward, he saw sidewalks littered with the wounded, including one man "dripping enough blood to leave a stream."

The officers who fired were part a detail regularly assigned to patrol landmarks such as the 1,454-foot-tall skyscraper since the Sept. 11 terror attacks, officials said.

Kelly, the police commissioner, said the officers who confronted Johnson had "a gun right in their face" and "responded quickly, and they responded appropriately."

"These officers, having looked at the tape myself, had absolutely no choice," he said.

A witness had told police that Johnson fired at the officers, but authorities say ballistics evidence doesn't support that. Johnson's gun held seven rounds, they said. He fired five times at Ercolino, one round was still in the gun and one was ejected when officers secured it, authorities said.

A loaded magazine was found in Johnson's briefcase.

Johnson legally bought the gun in Sarasota, Fla., in 1991, but he didn't have a permit to possess it in New York City, authorities said.

Mayor Michael Bloomberg said New York still is the safest big city in the country, on pace to have a record low number of murders this year.

"But we are not immune to the national problem of gun violence," he said of the shooting, following mass shootings at a Colorado movie theatre and a Sikh temple in Wisconsin.

The nine people wounded outside the Empire State Building were all from New York City, except for a woman from Chapel Hill, N.C. They suffered graze wounds or other minor injuries.

Metal detectors and bag searchers have been standard at the Empire State Building since 1997, when a gunman opened fire on the 86th-floor observation deck, killing one tourist and wounding six others before fatally shooting himself.

The skyscraper remained open Friday throughout the mayhem, although its workers became witnesses.

"We were just working here and we just heard bang, bang, bang!" said Mohammed Bachchu, a worker at a nearby souvenir shop.

He said he rushed from the building and saw seven people lying on the ground, covered in blood.

Rebecca Fox said she saw people running down the street and initially thought it was a celebrity sighting, but then she saw a woman shot in the foot and a man dead on the ground.

"I was scared and shocked and literally shaking," she said. "It was like 'CSI,' but it was real."

Manipulating the microbiome could help manage weight

ScienceDaily (Aug. 26, 2012) ? Vaccines and antibiotics may someday join caloric restriction or bariatric surgery as a way to regulate weight gain, according to a new study focused on the interactions between diet, the bacteria that live in the bowel, and the immune system.

Bacteria in the intestine play a crucial role in digestion. They provide enzymes necessary for the uptake of many nutrients, synthesize certain vitamins and boost absorption of energy from food. Fifty years ago, farmers learned that by tweaking the microbial mix in their livestock with low-dose oral antibiotics, they could accelerate weight gain. More recently, scientists found that mice raised in a germ-free environment, and thus lacking gut microbes, do not put on extra weight, even on a high-fat diet.

In a study, published Aug. 26 in the journal Nature Immunology, a research team based at the University of Chicago was able to unravel some of the mechanisms that regulate this weight gain. They focused on the relationship between the immune system, gut bacteria, digestion and obesity. They showed how weight gain requires not just caloric overload but also a delicate, adjustable -- and transmissible -- interplay between intestinal microbes and the immune response.

"Diet-induced obesity depends not just on calories ingested but also on the host's microbiome," said the study's senior author Yang-Xin Fu, MD, PhD, professor of pathology at the University of Chicago Medicine. For most people, he said, "host digestion is not completely efficient, but changes in the gut flora can raise or lower digestive efficiency."

So the old adage "you are what you eat" needs to be modified, Fu suggested, to include, "as processed by the microbial community of the distal gut and as regulated by the immune system."

To measure the effects of microbes and immunity, the researchers compared normal mice with mice that have a genetic defect that renders them unable to produce lymphotoxin, a molecule that helps to regulate interactions between the immune system and bacteria in the bowel. Mice lacking lymphotoxin, they found, do not gain extra weight, even after prolonged consumption of a high-fat diet.

On a standard diet, both groups of mice maintained a steady weight. But after nine weeks on a high-fat diet, the normal mice increased their weight by one-third, most of it fat. Mice lacking lymphotoxin ate just as much, but did not gain weight.

The high-fat diet triggered changes in gut microbes for both groups. The normal mice had a substantial increase in a class of bacteria (Erysopelotrichi) previously associated with obesity and related health problems. Mice that lacked lymphotoxin were unable to clear segmented filamentous bacteria, which has previously been found to induce certain immune responses in the gut.

The role of gut microbes was confirmed when the researchers transplanted bowel contents from the study mice to normal mice raised in a germ-free environment -- and thus lacking their own microbiome. Mice who received commensal bacteria from donors that made lymphotoxin gained weight rapidly. Those that got the bacteria from mice lacking lymphotoxin gained much less weight for about three weeks, until their own intact immune system began to normalize their bacterial mix.

When housed together, the mice performed their own microbial transplants. Mice are coprophagic; they eat each other's droppings. In this way, the authors note, mice housed together "colonize one another with their own microbial communities." After weeks together, even mice with the immune defect began to gain weight. They also were able to reduce the presence of segmented filamentous bacteria in their stool.

Moving from normal chow to the high-fat diet initiated a series of related changes, the authors found. First, it altered the balance of microbes in the digestive system. These changes in the microbiome altered the immune response, which then introduced further changes to the intestinal microbial community.

These changes "provide inertia for the obese state," the authors said, facilitating more efficient use of scarce food resources.

"Our results suggest that it may be possible to learn how to regulate these microbes in ways that could help prevent diseases associated with obesity," said Vaibhav Upadhyay, first author of the study and an MD/PhD student working in Fu's laboratory. "We now think we could inhibit the negative side effects of obesity by regulating the microbiota and perhaps manipulating the immune response."

Or, 20 years from now, "when there are 10 billion people living on earth and competing for food, we may want to tilt digestive efficiency in the other direction," Fu added.

The authors cautioned, however, that with more than 500 different strains of bacteria present in the gut, "the precise microbes that promote such weight gain and the specific host responses that foster their growth need to be better established."

The National Institutes of Health and the American Heart Association supported this research. Additional authors include Valeriy Poroyko, Tai-jin Kim, Suzanne Devkota, Sherry Fu, Alexei Tumanov, Ekaterina Koroleva, Liufu Deng, Cathryn Nagler and Eugene Chang of the University of Chicago, and Hong Tang of the Chinese Academy of Sciences.

The manuscript is dedicated to the memory of co-author Donald Liu, MD, PhD, who died Aug. 5.

With America's election day getting closer, Germans are following the tightening race between President Obama and Republican challenger Mitt Romney with increasing enthusiasm. Four years after Mr. Obama entered the White House he is still highly popular. But could Germans' interest in Romney rise with Paul Ryan on his ticket?

Consider: Romney, like German Chancellor Angela Merkel, is a fiscal conservative. In a time of global economic crisis, his support for spending cuts in the federal budget could in theory prove highly popular especially with ?Madame No,? the power player in the euro crisis. Meanwhile, Obama's heroic status has inevitably come down to earth overseas. A Pew Research study from June 2012 shows that global approval of the policies Obama has promoted has declined significantly since he first took office, though in Germany, 87 percent of participants still expressed confidence overall in the president.

Stimulus packages

But throughout the economic crisis, the Obama White House was encouraging Germany to support more debt-increasing stimulus packages. Germany resisted, with Mrs. Merkel arguing that decreasing the debt was the solution for regaining political authority.

?Superficially, one could argue that Romney and Merkel share the same economic interests,? says Josef Braml, Program Officer USA/Transatlantic Relations at the German Council on Foreign Relations (DGAP) in Berlin.

But Romney may still face an uphill battle in winning the hearts and minds of Germans and their leader.

Romney didn?t help himself with his Europe trip earlier this month, facing criticism for the countries he chose to visit and a number of his remarks. Then there is his economic philosophy.

The German and American definitions of conservative diverge sharply. Being conservative in Germany does not automatically mean promoting deregulation. ?In Germany, it is hardly imaginable to reduce the role of government in the way Romney/Ryan want to do it. The state and some regulation on the market play a bigger role in Europe,? says Mr. Braml.

Little social security

Merkel's politics are based on the social economic market, an economic model most political parties have followed since World War II. It's a compromise between social democracy and economic liberalism, combining private enterprise with government regulation to establish fair competition. ?Extensive cuts in social benefits, like Paul Ryan?s proposal to privatize Medicare, are not part of her political vision,? says Henriette Rytz from the German Institute for International and Security Affairs in Berlin. Germans have questions about how a Romney-Ryan team would cut government spending while expanding the military budget. And experts raise concerns about more social cuts in a system that ? compared to Germany ?? has little social security.

Moreover, whoever wins the presidential race in November is going to face a tough economic outlook for 2013. According to the Congressional Budget Office, the first half of 2013 will be difficult if currently planned spending cuts and tax hikes go into effect, with US GDP shrinking by 2.9 percent, followed by a second half growth rate of 1.9 percent.

This outlook will influence US foreign policy, Braml says. ?Neither a Democrat nor a Republican will have a lot of leeway. Because of its own economic problems, the USA will try to shift much of the burden onto its allies in Europe and Asia.?

Austerity policy

Looking at this global crisis, Merkel favors an austerity policy but also promotes a regulation of the financial sector and a financial transaction tax, something Romney would most likely not agree on.

?Given his campaign promise to repeal Dodd-Frank [Wall Street reforms], Romney is likely to object to government intervention in the global financial sector,? says Mrs. Rytz.

Merkel might give a future president Romney a warm welcome as a sometime-fellow conservative, but the differences in their economic policies would not likely translate into an immediately tight-knit relationship. And at any rate, for the next year, with an election looming, Merkel's main preoccupation jibes more closely with Obama's: getting reelected.

NASA successfully delivered a $2.5 billion robotic vehicle to Mars, one that will explore for signs that the planet might once have hosted life

On August 5, after a journey lasting more than 8 months, a carlike rover carefully settled down onto the surface of Mars. The vehicle is basically a science lab. Its mission: to search for evidence that the Red Planet might once have hosted life ? even if the organisms were only one-celled microbes.

The first stage of this mission ? the landing ? is ?an amazing achievement,? observes Charles Bolden. He runs the National Aeronautics and Space Administration, or NASA, which built and delivered the vehicle to Mars.

Several years ago, NASA scientists began considering the best place for Curiosity to conduct its experiments. Last year, the researchers chose Gale Crater. So that?s where the rover landed. A towering peak ? Mount Sharp ? rises from the center of this basin 150 kilometers (93 miles) wide. Curiosity will spend two years motoring around and exploring the crater floor. But probing the mountain will be the vehicle?s primary focus. As Curiosity moves by, it will shoot out a laser beam at the mountain and then direct onboard chemical samplers to ?taste? the vaporized rock. Another onboard device can drill into rock, pulverizing it into a fine powder for the rover?s chemical samplers to taste.

Consumer group files motion to oppose Google, FTC settlement

The settlement agreement between the U.S. Federal Trade Commission and Google, which cost the search giant?$22.5 million in penalty charges,?is being challenged in court.

The search giant managed to avoid pleading guilty or admitting any wrongdoing in its settlement deal with the commission -- something that irked the higher-up's at the FTC?--?and could spark a change in future policy to disallow firms to avoid getting away from their troubles scot-free.

But one U.S. group, Consumer Watchdog, believes this isn't right. In response, the consumer advocacy group has filed a motion [PDF] in a bid to allow the group to submit briefs that formally oppose the FTC settlement with Google.

In a nutshell:?John Simpson, the consumer groups' privacy project director, said:?

"Google hacked past a key privacy setting on iPhones and iPads and other devices using Apple's Safari browser, placed tracking cookies on them and then lied, saying the settings were still effective. Clearly it violated its agreement with the FTC."

The group wants the?U.S. District Court for the Northern District of California, which will accept or reject the deal, to throw out the settlement offer and force Google to swallow a whole heap of humble pie.

The motion says the settlement is "not in the public interest" because the settlement "continues to deny any violation of the prior FTC order," notably the privacy agreement set out by the FTC over Google Buzz in 2010.

"The Commission is proposing to let Google buy its way out of trouble for an amount that is less than the company spends on lunches for its employees and with no admission it did anything wrong," Simpson said.

As ZDNet editor-in-chief Larry Dignan pointed out, based on Google's Q2 sales, the $22.5 million penalty could have been recovered by the search giant in just five hours.

Google has already made steps to bolster its privacy track record in light of the Safari security bypass fiasco. A recent job listing said the search giant is building a "red team" in order to scrutinize?the firm's products to avoid such brouhaha's like it faced with the FTC this year, among others.

Obama mocks Akin, says Akin missed science class

NEW YORK (AP) ? President Barack Obama is mocking Senate candidate Todd Akin of Missouri for his remarks about a woman's body being able to avoid pregnancy during what Akin called a "legitimate rape."

Obama tells a group of donors in New York that the Republican congressman from Missouri "somehow missed science class" even though he sits on the House Committee on Science, Space and Technology.

Obama says Akin's remarks are representative of what Obama called "the desire to go backwards instead of forwards and fight fights that we thought were settled 20 or 30 years ago."

Akin has refused calls from within the GOP to drop his bid to challenge Democratic Sen. Claire McCaskill. He made the remarks in a TV interview last Sunday while defending his opposition to abortion in all circumstances.

Michelle Mohr, 27, of Florida, was admittedly ?super, super strict? about her diet when she decided to lose weight after years of ?feeling invisible? in her group of ?normal-sized? friends. She was 5?4? and 210 pounds. She?s now 110 pounds and has never been more confident.

?I never thought I would look like this in a bikini!? she says.

Michelle reflects on her past:

?Growing up, I was always the fat kid. Lunch would be pizza, fries, and nachos. I?d come home from school and eat a box of stuffing that could serve a family of four!

?Then I?d eat two plates of spaghetti for dinner. I was teased by kids and so embarrassed. I remember sitting on the couch and bawling, ?I?m never going to be thin!?

?But after college I changed my life. I read magazines, watched videos online, and tailored my own plan. Now I go to the gym five days a week. Recently I?ve been more comfortable buying swimsuits and going to the beach in a group. I love having confidence!?

Breakfast: 2 scramled egg whites, 1/2 cup fat-free cottage cheese, an apple, a slice of toast and 9 almonds.

Lunch: Salad with chicken, chickpeas, mushrooms, celery and tomato.

Snack: String cheese and 1/2 cup grapes.

Dinner: Grilled chicken with zucchini and half a sweet potato.

Dessert: Sugar-free fudge pop

Isaac poses potential problems for RNC

TAMPA, Fla. (AP) ? All Isaac needs to do is come close to Tampa to bring a lot of problems to the Republican National Convention. Even during an average summer thunderstorm in this area, major roads can flood.

When a tropical storm raked the Tampa Bay area a couple of months ago, thousands of homes and businesses lost power, tornadoes spun off and streets and bridges were closed. It's still too early to say where Isaac will end up, but officials are closely watching the storm and say they're ready to make any decisions, if needed, about evacuations or cancellations as 70,000 delegates, journalists and protesters descend on the city.

"Public safety will always trump politics," Tampa Mayor Bob Buckhorn said. "And so my job, and our job, if we move into that mode, is to make sure we get people out of harm's way. I don't care whether they're anarchists or they're delegates."

The current forecast has Isaac strengthening into a hurricane Thursday night and heading toward South Florida, arriving around Monday, the opening day of the convention and nearly a week of parties, speeches and other events culminating with the coronation of Mitt Romney.

The storm was still hundreds of miles from the tip of Florida on Wednesday, with maximum sustained winds of 45 mph. Forecasters warned there was still a great deal of uncertainty with Isaac, and it could miss the state altogether.

"The storm is so far away at this point, the cone of error from this point out is tremendous," said Florida Emergency Management Director Bryan Koon, who has been in constant contact with RNC officials about the storm threat.

Koon has been coordinating security and convention planning with party officials for more than a year. He said there was no reason out-of-state visitors should cancel their plans, and RNC officials were so far echoing that advice.

Nebraska GOP Executive Director Jordan McGrain said there was no consternation or concern from any of the delegates or guests prepared to head south. After all, he said Nebraskans are used to dealing with severe weather and tornadoes every spring.

"We can deal with extremes of every kind. I'm sure most of us would welcome a tropical storm as a new experience," McGrain said. "We're ready to ride it out."

Still, officials had to be prepared for the worst-case scenario, a hurricane in the Gulf, making landfall just north of Tampa, pushing even more water and wind into the Tampa Bay area, said Alex Sosnowski, a meteorologist from AccuWeather. Because a storm can often affect areas 100 miles from its center, people were told to pay attention.

The city's geography has posed logistical challenges from the outset, including how people would get around a downtown that is only about 571 acres ? or less than 1 square-mile ? and is bordered by interstates and rivers, and punctuated with restaurants, cafes and offices. As many as 400 air-conditioned buses are expected to shuttle delegates and other visitors from their hotels on both sides of the bay to the Tampa Bay Times Forum, the downtown hockey arena hosting the festivities.

Any evacuation orders for the arena, where Romney will give his acceptance speech, would depend on a variety of factors, and would most likely not be made simply because a Category 1 storm, with winds of 74 mph, was approaching, officials said. Some visitors may not even be staying in would-be evacuation zones. Hotels have been booked 20 miles or more from downtown Tampa.

Debra Sue Warshefski, spokeswoman for Tampa Fire Rescue, said the city will provide buses for people to get to shelters and she hoped protesters, especially those who are camping, would take advantage of any offers of help.

"If we call for an evacuation, are we going to require an evacuation and arrest them? No we're going to offer the opportunity for their safety," she said.

The last hurricane to strike Tampa was Hurricane Jeanne in 2004. The Category 1 storm moved across the state toward Tampa, weakening along the way. It still knocked down trees and power lines, and damaged buildings. Three people were killed, but none in the Tampa Bay area.

Director of meteorology at Weather Underground, Jeff Masters, said based off the latest forecasts and computer models, there was a 3 percent chance of needing to evacuate the arena hosting the convention. There was 9 percent chance of Tampa experiencing tropical storm-force winds of at least 39 mph when the convention begins.

"Those odds are probably going to rise," he said.

Nike will launch the latest LeBron James shoe line this fall - identical to the red-white-and-blue pair James wore, and debuted, during Team USA's gold medal victory over Spain at the London Olympics. According to an email sent by Nike late Tuesday, the suggested retail price of the sneakers will be?$180.?

On Tuesday morning, numerous reports, including an early morning story in?The Wall Street Journal, stated the new shoe would be sold for $315. That would have made the new LeBron X+ sneakers the company's highest-costing basketball sneaker.

At the end of the day, more than 12 hours after the original Wall Street Journal story appeared and roughly the same span of hours that the price point began leaking to other news outlets, Nike sent an email revealing the shoe's true price.?

"The LEBRON X will be launched in the Fall at a suggested retail price (SRP) of $180," read an email from Nike spokesman Brian Strong, sent at 9:14 p.m. Eastern Time. "The initial introduction of the LEBRON X will be the red, white and blue Nike+ enabled version and that price is still being set, but will be at a higher price to reflect the Nike+ technology embedded in the shoes. Nike continues to offer shoes at various price points for consumers, including currently in the marketplace the LeBron Zoom Soldier basketball shoe at a SRP of $120 and the Nike Zoom Hyperfuse at a SRP $110."

Five hours earlier, when NBC News asked Strong if this $300-plus price point was established to reflect James' recent gold-medal performance and his team's NBA title, Strong replied via email: "We're not confirming/commenting on the the (sic) ?LeBron?X price." NBC News immediately sent a follow-up question to Strong, asking by email: "Well, let's start with that reported price - reported all over the place?today: Is $315 incorrect?" Strong replied by email: "Just to reiterate, we're not yet commenting on the price of the LeBron X+."

In the basketball category, Nike?s highest-priced shoes are the LeBron 9 PS Elite, which goes for $250, and the Nike?Hyperdunk+ Sport Pack, also priced at $250.

Compare that to a pair of Air Jordans ? once the coolest kicks on the planet ? which sold for about $65 in 1985.?

?Normally, as a sneakerhead, when you see a high price point, you think it?s for a limited shoe, like 1,000 or 2,000 pairs. From what I?ve seen, the LeBron X? will be 50,000 pairs,"?said Jamie Delaney, public relations and social media manager at rEvolution, a sports marketing and media services agency in Chicago.

?That?s kind of a turn off for me. As a sneakerhead, the whole allure of collecting sneakers is to get something that not a lot of people can get,? Delaney said. ?It?s interesting that they?re trying this strategy ? not taking reservations and they?re going to put them in retail like any other basketball shoe."

Delaney?s favorite sneakers to wear? A pair of 2011 Air Jordan 3 Black Cement re-releases. ($160).?

?It?s one of everyone?s favorite shoe. For me, I like the cement and the elephant-skin design of it. It?s a comfortable shoe. It?s a way of making a statement with the way you dress without having to go buy new jeans and a new shirt. And you can wear it every day.

?Or you can just leave it in the box, like I do."

He has two pairs, actually ? one for show, one still in the original box.

?Usually, most people have a pair to rock and a pair to stock,? Delaney said. "That?s the way we put it.?

According to the website Zappos, the most expensive athletic shoes on the market include a pair Marc Jacobs Quilted Low Top Trainers that fetch $640 and a pair of DSquared Wings High Tops, listed at $595.
